Une proposition de loi veut restreindre le rôle de certains commissaires au sein des autorités administratives indépendante (AAI). Le texte concerne notamment la Commission de régulation de l’énergie (CRE), qui redoute de voir son expertise sur les problématiques énergétiques et environnementales amoindrie.
La CRE a été créée en mars 2000 pour surveiller le marché de l’énergie. Depuis, selon l’article L 133-6 du code de l’énergie, ses membres « exercent leurs fonctions en toute indépendance et en toute impartialité ». Pourtant, malgré cette disposition, une proposition de loi serait actuellement à l’étude afin d’empêcher certains commissaires de prendre part à certaines décisions.
En effet, les membres des collèges du gendarme de l’énergie ne pourront pas statuer, dès lors que « dans les trois années précédentes, ils ont exercé des fonctions ou détenu des actions » d’une entreprise du secteur de l’énergie ou de l’environnement. Une mesure qui vient s’ajouter à celles prévues dans le cadre de la loi sur la Nouvelle Organisation des Marchés de l’Électricité (loi NOME) de 2010 (interdiction d’exercer une activité dans le secteur pendant trois ans à l’issue du mandat) et par la loi sur la transparence de 2013 (déclaration de patrimoine).
Le texte à l’étude génère pourtant des craintes au sein de la CRE, qui souhaite défendre ses capacités d’expertise. Frédéric de Monicault, journaliste au Figaro, rapporte certaines de ces inquiétudes : « Nous travaillons sur des problématiques complexes, qui mêlent des volets industriels, économiques, juridiques, sociaux ou encore financiers, pense-t-on dans l’entourage du gendarme de l’énergie. Il est important que le collège dispose en son sein d’une forte expertise sectorielle, pour que la CRE puisse jouer efficacement son rôle dans les mutations du paysage énergétique. »
